MINUTES

TOWN OF VERMONT PLAN COMMISSION MEETING

FEBRUARY 27, 2006

The meeting was called to order by Barbara Grenlie at 7:30 p.m. Marian Swoboda reported the notice of the meeting had been posted at the Black Earth State Bank, Amcore Bank in Mount Horeb, on the front door of the Town Hall and on the town web site, www.townofvermont.com: also published in the News Sickle Arrow and the Mount Horeb Mail.

Members present: Barbara Grenlie, Marian Swoboda, Donald McKay, Marc Roberson, Mark Sherven, Jim Elleson, Bruce Ellarson.

APPROVAL OF AGENDA

Motion was made by Mark Sherven seconded by Marc Roberson and carried to approve the meeting agenda.

APPROVAL OF MINUTES

Motion was made by Jim Elleson seconded by Donald McKay and carried to approve the January 30, 2006 meeting minutes as amended.

DISCUSSION WITH FREDERICK & JILL CURKEET

The purpose of the discussion was to determine whether or not there is a potential building site on land owned by the Abigail Curkeet Living Trust in the SW 1/4 of the NE 1/4 of Section 23, Town 7 North, Range 6 East, Town of Vermont.

According to a September 13, 2005 Settlement Agreement to a lawsuit dated June 24, 2005, the parties to the lawsuit were ordered to split said property into two separate parcels, with William & Maredith Resop purchasing the property North of Moe Road and the Abigail Curkeet Living Trust retaining ownership of the remaining property South of Moe Road. (See Exhibit "A")

Based upon property tax assessment records which are used to determine potential building sites, Abigail D. Curkeet owned 34.5 acres as of January 1, I985. Because the house located on the property was "grandfathered" one potential building site was allocated to said 34.5 acres (1985 Parcel #30-23-463, current parcel #0706-231-9000-7). (See Exhibit "B")

Motion was made by Donald McKay seconded by Marian Swoboda and carried that the Plan Commission hereby affirms that a potential development right (PDR) existed with Parcel #30-23-463 in 1985 and further to acknowledge that on September 13, 2005 by court order the parcel was to be split into two separate parcels with the Abigail Curkeet Living Trust retaining the ownership of the property South of Moe Road together with any development rights. REVISED HOME SITE AND DRIVEWAY PETITION LARRY & PATRICIA ZIEMER

The Ziemers presented a revised preliminary certified survey map moving the home site closer to County JG thereby reducing the length of the driveway. (See Exhibit "C". It was noted on the driveway construction map that a portion of the sideslope adjacent to the proposed driveway exceeded the normally desired 3:1 slope. The commission determined this to be acceptable with the understanding that steps will be taken to preserve mature vegetation with necessary erosion control measures including control matting.

With regard to the allocation of the three potential building rights on land owned by the Diehls on January 1, 1985, Barbara Grenlie reported that the Land Use Intent Application submitted by Roland Diehl and Daniel McMeen on March 3, 1986 indicates two potential lots went with the sale of 65 acres to the McMeens. (See Exhibit "D"^ The Roland & Edith Diehl index card on potential building sites shows 34.55 acres were sold to the Ziemers along with one potential building site (lot) and 64.55 acres was sold to the McMeens along with two potential building sites (lots). (See Exhibit "E")

Motion was made by Mark Sherven seconded by Jim Elleson and carried with Barbara Grenlie abstaining that the commission recommend approval of the proposed home site and driveway location on the Ziemer property based upon the following conditions:

1. That a deed granting ownership of a triangle piece of land on the driveway entrance be given to the Board for the March 13 meeting. (See Exhibit "F")

2. That a revised page to the Erosion Control Plan be given to the board showing all side banks exceeding a 3:1 slope.

3. That the documents pertaining to the Ziemer's potential building site noted at the meeting are sent with the March 13 board meeting notice. (Please refer to Exhibts "D" & "E")

Motion was made by Mark Sherven seconded by Jim Elleson and carried to adjourn the meeting.

The meeting was adjourned at 10:20 p.m.
